These terms and conditions apply to the Rack Star (also distributed as Rack Star Training) app for mobile devices and web browsers, together with any related services operated by Shynnergy, LLC (collectively, the "Application"). Shynnergy, LLC is hereby referred to as the "Service Provider".
By downloading, installing, or using the Application, you agree to these Terms and Conditions. You should read them carefully before using the Application.
Subject to your compliance with these Terms, the Service Provider grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Application on compatible mobile devices and web browsers for personal, non-commercial training and recreation. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or extract the source code of the Application, except to the extent permitted by applicable law.
The Service Provider retains all intellectual property rights in the Application, including its source code, visual designs, trademarks, logos, audio-visual elements, and custom tile illustrations. You agree not to remove or alter any copyright or proprietary notices displayed within the Application.
Disclaimer Regarding the National Mah Jongg League: Rack Star is an independent practice and training simulator developed for educational purposes. Reference to American Mahjong rules, hands, and standard card conventions is made purely for training simulation. Rack Star is not endorsed by, sponsored by, or affiliated with the National Mah Jongg League, Inc. (NMJL). Players are encouraged to purchase an official hands card annually from the NMJL.
Certain features, such as cross-device progress synchronization and advanced practice analytics, may require signing in with a supported authentication provider (such as Google). You are responsible for safeguarding your login credentials and for all activities that occur under your account.
You agree not to use the Application for any unlawful purpose or in any manner that could interfere with, disrupt, or negatively affect the servers, networks, or other users of the Application. Any automated scraping, unauthorized API queries, or vulnerability probing is strictly prohibited.
While many drills and practice exercises can run offline, account synchronization, card updates, and feature unlocking require an active internet connection (Wi-Fi or mobile cellular network). The Service Provider is not responsible for connectivity issues or cellular data carrier charges incurred during your use of the Application.
The Application may offer optional in-app purchases or subscription plans (such as access to advanced simulators or historical analytics). Subscriptions are billed through Apple App Store, Google Play, or authorized payment processors. Renewal, cancellation, and refund terms are governed by the respective store's purchase policies.
To the fullest extent permitted by applicable law, the Service Provider and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Application, even if advised of the possibility of such damages.
To the maximum extent permitted by law, the Service Provider's total aggregate liability for all claims arising from the Application will not exceed the amount actually paid by you to the Service Provider for the Application during the twelve (12) months preceding the event giving rise to the claim, or $20 USD, whichever is greater.
You agree to indemnify and hold harmless the Service Provider from and against any claims, losses, liabilities, damages, expenses, and costs (including reasonable legal fees) resulting from your violation of these Terms or intentional misuse of the Application.
To the extent the Application falls under the Digital Services Act (Regulation (EU) 2022/2065, "DSA"), the Service Provider provides a single point of contact for direct communication with EU authorities and users at shynnergy@gmail.com. Any moderation actions or service restrictions will be accompanied by a statement of reasons in accordance with applicable DSA standards.
The Service Provider reserves the right to suspend or terminate your access to the Application at any time if you materially breach these Terms or engage in conduct harmful to the service or other users. You may terminate these Terms at any time by ceasing all use and deleting the Application from your devices.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Delaware, subject to mandatory local consumer protection rules.
The Service Provider reserves the right to modify these Terms at any time. When updates are made, the revised date at the top of this page will be updated. Your continued use of the Application following such notification constitutes your acceptance of the updated Terms.
